✔ Hyperlinking to third-party websites is not copyright infringement by itself
✔ Liability arises only if you:
- Host or embed infringing content
- Intentionally promote piracy
- Ignore valid takedown notices
As long as your anime site:
- Uses standard outbound hyperlinks only
- Does not iframe, mirror, or proxy content
- Does not label links as “official downloads”
You remain within Safe Harbor principles.
WIPO & Berne Convention Interpretation
International copyright treaties:
- Protect the content itself
- Do not prohibit linking or referencing external sources
Courts and regulators globally distinguish between:
- Providing content (illegal if unlicensed)
- Providing references (generally legal)
Pakistani Law Position on Linking
Copyright Ordinance, 1962 (Pakistan)
Under Pakistani law, infringement requires direct involvement in:
- Reproduction
- Distribution
- Public communication
✔ Simple linking does not meet these thresholds
You are not liable unless you:
- Upload anime files
- Stream content on your server
- Actively encourage illegal copying
PECA Act, 2016
The Prevention of Electronic Crimes Act does not criminalize hyperlinking.
Risk arises only if a website:
- Facilitates hacking or circumvention
- Intentionally assists illegal activity
Neutral listing + outbound links = lawful activity.
