International Law Position on Linking

DMCA Safe Harbor (17 U.S.C. §512)

Under DMCA jurisprudence and global best practices:

Hyperlinking to third-party websites is not copyright infringement by itself
✔ Liability arises only if you:

  • Host or embed infringing content
  • Intentionally promote piracy
  • Ignore valid takedown notices

As long as your anime site:

  • Uses standard outbound hyperlinks only
  • Does not iframe, mirror, or proxy content
  • Does not label links as “official downloads”

You remain within Safe Harbor principles.


WIPO & Berne Convention Interpretation

International copyright treaties:

  • Protect the content itself
  • Do not prohibit linking or referencing external sources

Courts and regulators globally distinguish between:

  • Providing content (illegal if unlicensed)
  • Providing references (generally legal)

Pakistani Law Position on Linking

Copyright Ordinance, 1962 (Pakistan)

Under Pakistani law, infringement requires direct involvement in:

  • Reproduction
  • Distribution
  • Public communication

Simple linking does not meet these thresholds

You are not liable unless you:

  • Upload anime files
  • Stream content on your server
  • Actively encourage illegal copying

PECA Act, 2016

The Prevention of Electronic Crimes Act does not criminalize hyperlinking.

Risk arises only if a website:

  • Facilitates hacking or circumvention
  • Intentionally assists illegal activity

Neutral listing + outbound links = lawful activity.
